Welcome to MRP Indian Store.

These Terms and Conditions govern your access to and use of the MRP Indian Store website, stores, online ordering facilities and related services.

By accessing our website, creating an account, placing an order or purchasing products from us, you acknowledge that you have read and agree to these Terms.

1. About MRP Indian Store

MRP Indian Store is an Australian retail business focused on making Indian groceries, household products and familiar Indian brands available to customers in Australia through a fair and transparent pricing model.

References to “MRP”, “MRP Indian Store”, “we”, “our” and “us” refer to:

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or protection that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Consumer guarantees apply automatically and cannot be removed by a retailer’s website terms or refund policy.

Where there is an inconsistency between these Terms and a mandatory consumer right, the mandatory consumer right will prevail.

3. Eligibility

You must have legal capacity to enter into a binding agreement to place an order through our website.

If you place an order on behalf of another individual, business or organisation, you confirm that you have authority to do so.

4. Product Information

We take reasonable care to present product information accurately.

However, manufacturers may change packaging, product design, ingredients, size, country of manufacture or specifications without advance notice.

Images displayed on the website are provided to assist with product identification and may not always represent the exact packaging supplied.

Customers should inspect the actual product packaging and label before use or consumption.

5. Indian MRP and Our Pricing Model

MRP stands for Maximum Retail Price, a pricing concept commonly displayed on products sold for the Indian market.

MRP Indian Store’s aim is to provide customers in Australia with Indian products using a transparent pricing model connected to their Indian MRP wherever that model is advertised as applying.

Where we specifically advertise a product as being sold at Indian MRP, the methodology used to convert or determine the Australian selling price must be clearly communicated.

The final price legally payable by the customer is the price displayed in Australian Dollars (AUD) at the point of sale or checkout.

Important before launch: MRP should publish its actual conversion methodology here. For example:

“[Insert: We convert the printed Indian MRP from INR to AUD using ______ exchange-rate methodology, updated ______, with rounding applied to ______.]”

You should not leave this methodology ambiguous if advertising claims such as “true Indian MRP” or “genuine Indian MRP” are used.

Australian businesses must communicate prices clearly and accurately, must not mislead customers about pricing, and generally must show the minimum total price including unavoidable taxes, duties and fees.

A printed Indian MRP appearing on imported packaging does not itself replace the Australian Dollar price displayed by MRP Indian Store.

6. Australian Dollar Pricing and GST

Unless otherwise stated, website and store prices are displayed in Australian Dollars.

Prices will include GST where GST is applicable and is required to be included in the displayed price.

Delivery charges and optional services may be added separately where applicable and will be disclosed before an online order is completed.

7. Price Changes and Errors

Prices may change from time to time.

We reserve the right to correct genuine website or system errors.

However, we will comply with Australian laws regarding displayed pricing and misleading representations.

Where multiple prices are displayed in circumstances governed by Australian Consumer Law, applicable legal requirements will take priority over these Terms.

8. Product Availability

All products are subject to availability.

Adding an item to a shopping cart does not guarantee availability.

If a product becomes unavailable after an order is placed, we may:

contact you regarding an alternative product; provide an appropriate refund; adjust the order with your agreement; or take another reasonable action permitted by law.

We will not intentionally substitute a materially different item without your agreement unless you have expressly selected a substitution option when ordering.

9. Orders

Placing an order constitutes an offer by you to purchase the selected products.

An automated order confirmation acknowledges that your order has been received but does not necessarily mean that every item has been accepted or confirmed as available.

We may reject or cancel an order for legitimate reasons, including stock unavailability, suspected fraud, an obvious system error, payment failure or legal/regulatory restrictions.

Where payment has been taken for an order that we cannot supply, we will provide the remedy required by Australian law.

10. Payment

You must pay the amount shown at checkout using one of the payment methods offered by us.

Payments may be handled by third-party payment service providers and may also be subject to their terms and privacy policies.

We may perform reasonable payment and fraud checks before processing an order.

11. Delivery

Delivery availability, delivery areas, delivery charges and estimated delivery times may vary depending on location and order characteristics.

Any delivery time provided is an estimate unless we expressly state otherwise.

Customers are responsible for providing an accurate and accessible delivery address together with appropriate delivery instructions.

If a delivery cannot be completed because incorrect information was provided or nobody is available where attendance is reasonably required, additional delivery charges may apply where lawful and disclosed.

12. Refrigerated, Frozen and Perishable Products

Certain grocery items require controlled storage.

Customers should refrigerate, freeze or otherwise store products in accordance with packaging instructions promptly after delivery or collection.

Where delivery instructions allow products to be left unattended, customers should consider whether the location is appropriate for perishable goods.

Nothing in this section limits rights relating to unsafe, damaged or non-compliant products under Australian Consumer Law.

13. Returns, Refunds and Consumer Guarantees

Our products come with statutory consumer guarantees under Australian Consumer Law.

Depending on the circumstances, customers may be entitled to a repair, replacement, refund or other remedy where goods:

are faulty; are unsafe; are not of acceptable quality; do not match their description; or otherwise fail to meet an applicable consumer guarantee.

MRP may assess a product before determining the appropriate remedy where permitted by law.

A customer is generally not automatically entitled to a refund simply because they changed their mind, selected the wrong product, no longer want the product or found it cheaper elsewhere, unless MRP has separately offered a voluntary change-of-mind policy.

Any MRP voluntary returns policy operates in addition to, and does not replace, Australian Consumer Law rights.

14. Food Allergies and Dietary Requirements

Customers with food allergies, intolerances, religious dietary requirements or other dietary restrictions should read the current physical product label before consuming a product.

Food allergen declaration requirements apply to manufacturers, retailers and importers in Australia.

If you are uncertain about a product, please contact us before consumption.

15. Promotions and Discount Codes

Promotions may be subject to separate conditions such as:

minimum purchase requirements, expiry dates, product exclusions, geographic restrictions, one-use limits or availability restrictions.

Unless expressly permitted, promotional offers cannot be combined.

We may withdraw or correct a promotion where there has been a genuine error, misuse or technical issue, subject to applicable consumer law.

16. Customer Accounts

Where account functionality is provided, you are responsible for keeping your login details confidential.

You must provide accurate information and promptly update information that changes.

You should notify us if you believe your account has been accessed without authority.

17. Acceptable Website Use

You must not use the website to:

commit fraud; interfere with website security; introduce malicious software; unlawfully collect customer information; impersonate another person; submit false information; infringe intellectual-property rights; or engage in activity prohibited by Australian law.

18. Intellectual Property

Unless otherwise indicated, website content created or owned by MRP, including branding, graphics, text, photographs, website design and promotional material, is owned by or licensed to MRP Indian Store.

Third-party product names, logos and trademarks remain the property of their respective owners.

MRP does not control those websites and is not responsible for their content, availability, privacy practices or terms.

20. Limitation of Liability

To the maximum extent permitted by law, MRP excludes warranties, representations and liabilities that may lawfully be excluded.

Nothing in these Terms excludes liability or remedies that cannot legally be excluded, including applicable rights under Australian Consumer Law.

MRP will not be responsible for losses caused solely by circumstances outside our reasonable control except where liability cannot legally be excluded.

21. Franchise Enquiries

Information on this website concerning MRP franchise opportunities is provided for general preliminary information only.

Website information does not constitute:

a franchise agreement; a formal offer to grant a franchise; financial advice; legal advice; investment advice; a guarantee of earnings; a guarantee of profitability; or a representation that any proposed location will be approved.

Submission of a franchise enquiry or application does not create a franchisor-franchisee relationship and does not oblige MRP to offer or award a franchise.

Prospective franchisees should undertake their own due diligence and obtain independent legal, financial, accounting and business advice.
